Meeting, June 13, 2002

 

Present:  Paul Connolly, Raphael Herz, Jeff Phillips

Absent:  Phil Verzani and Linda Wollschlager

 

The meeting was called to order by the chair at 7:00 PM in the Retirement Board Conference Room, Third Floor, Town Hall. The notice for the meeting had been sent to the Town Clerk for posting on April 1; the agenda had been sent on June 7.

 

Minutes of the June 6 meeting were approved as written.

 

The committee considered some items in the Awaiting Review table. Mr. Phillips recused himself during consideration of By-Laws, Article 10, s. 3. Several items were scheduled for ongoing review. In addition, for the following items, the committee voted unanimously to take no action to change the designated sections:

 

By-Laws, Art. 10, s. 3. How does this section agree with Article 22, Section 6?

By-Laws, Art. 11, s. 3. Are Town Reports permanently bound by the Town Clerk?

By-Laws, Art. 26, s. 1. Should sentences in first paragraph referencing when the commission is first established be removed?

By-Laws, Art. 27, s. 3. Does the Information Systems Advisory Board meet at least 4 times a year?

By-Laws, Art. 40, s. 3. First paragraph: Are the provisions on minutes being followed? Second paragraph on location of minutes: Is Town Clerk being notified? Should Town Clerk follow up with those who have not sent notification?

By-Laws, Art. 41, s. 1. These amounts have been changed by ATM 10/10/00, Art 37. The new amounts are $5,000 and $25,000.

 

The committee discussed the specific items on the agenda. (In these minutes, the items are referenced by the short designation that appears in the agenda.)

 

By-Laws, Art. 30, s. 2, 2.4.1, 2.5, 2.5.1, 2.9. Wetlands Protection by-law. Mr. Herz had obtained feedback from the Conservation Commission contact. The Conservation Commission agreed with the renumbering and the correction of an error and also instructed the chairman to look at several definitions and the provisions for emergency reporting. More feed back will come.

 

Charter, Art. 3, s. 3-12. Recreation Commission; park maintenance. Mr. Herz requested that Mr. Phillips attend the next meeting of the Recreation Commission in order to discover what objectives the Recreation Commission is seeking in changes to this section.

 

The chair welcomed the offers of members to coordinate with the Town administration to learn if the provisions of certain by-laws are aligned with current practice: (1) Mr. Connolly with the Treasurer/Collector regarding Article 12; (2) Mr. Connolly with Town Counsel regarding Article 22; (3) Mr. Phillips with the Police Chief regarding Article 52.

 

Committee members reported on their review of the By-Laws, Articles 51,52, 73, and 74. Identified items were added to the list of items awaiting review by the committee.

 

The meeting adjourned at 8:57 PM.
